释义	法律分析：在校的学生是不能与用人单位建立劳动关系的，大学生毕业前到单位实习，应签三方协议，同时，也可以签劳动合同，但合同起始时间必须是毕业后的时间。未毕业前是学生，执行三方协议约定的条款，毕业后，三方协议自行终止，执行劳动合同约定的条款。法律依据：《中华人民共和国劳动合同法》第十六条劳动合同由用人单位与劳动者协商一致，并经用人单位与劳动者在劳动合同文本上签字或者盖章生效。劳动合同文本由用人单位和劳动者各执一份。
