释义	开发商垫资不符合法律规范。垫资售房可以使缺乏资质的人取得贷款，绕过风险监测，变相突破住房信贷政策，使得统计数据失真，阻碍甚至减弱楼市调控效果。【法律依据】《贷款通则》第二十四条第一款、第五款、第六款贷款的发放必须严格执行《中华人民共和国商业银行法》第三十九条关于资产负债比例管理的有关规定，第四十条关于不得向关系人发放信用贷款、向关系人发放担保贷款的条件不得优于其他借款人同类贷款条件的规定。不得给委托人垫付资金，国家另有规定的除外。严格控制信用贷款，积极推广担保贷款。
