释义	法律分析：不能单纯的说鉴定结论就是直接证据，鉴定意见的本质是一种证人证言，所以，它的质证同证人证言质证规则相同。能单独证明犯罪行否犯罪实施证据就是直接证据，需要证据结合才能作述证明就是间接证据。鉴定结论属于证据的一种。在诉讼中运用专门知识或技能，对某些专门性问题进行检验、分析后所作出的科学判断，称为鉴定。法律依据：《中华人民共和国刑事诉讼法》第四十六条只有被告人陈述，没有其他证据的，不能认定被告人有罪和处以刑罚；没有被告人陈述，证据充分确实的，可以认定被告人有罪和处以刑罚。
