释义	律师分析: 没有合同不能出担保函。担保合同是主合同的从合同，主合同无效，担保合同无效，所以没有合同自然不能出担保函。所谓担保函是指银行、保险公司、担保公司或个人应申请人的请求，向第三方开立的一种书面信用担保凭证。【法律依据】: 《中华人民共和国民法典》第六百八十六条当事人在保证合同中对保证方式没有约定或者约定不明确的，按照一般保证承担保证责任。这与现行《担保法》第十九条的规定正好相反，该条规定，对保证方式没有约定或者约定不明的，按连带责任保证承担保证责任。
