释义	第一，要约人是发出要约的一方，要约人可以在要约中规定要约的有效期，受要约人是接收要约的一方；第二，要约人发出要约之后，受要约人需要作出承诺，要约才发生法律效力，如果要约人是出卖特定物的，那么不可以再向其他人提出同样的相同要约或订立同样的合同，否则需要承担给受要约人带来的损失。法律依据: 《中华人民共和国民法典》第四百七十八条有下列情形之一的，要约失效：（一）要约被拒绝；（二）要约被依法撤销；（三）承诺期限届满，受要约人未作出承诺；（四）受要约人对要约的内容作出实质性变更。
