法律分析：当事人一方不履行合同义务或者履行合同义务不符合约定的，应当承担继续履行、采取补救措施或者赔偿损失等违约责任。
法律依据：《旅游法》第七十条：旅行社不履行包价旅游合同义务或者履行合同义务不符合约定的，应当依法承担继续履行、采取补救措施或者赔偿损失等违约责任;造成旅游者人身损害、财产损失的，应当依法承担赔偿责任。旅行社具备履行条件，经旅游者要求仍拒绝履行合同，造成旅游者人身损害、滞留等严重后果的，旅游者还可以要求旅行社支付旅游费用一倍以上三倍以下的赔偿金。
