释义	《民法总则》第十九条规定：“8周岁以上的未成年人为限制民事行为能力人，实施民事法律行为由其法定代理人代理或者经其法定代理人同意、追认，但是可以独立实施纯获利益的民事法律行为或者与其年龄、智力相适应的民事法律行为。”据此，8周岁以上的孩子，既可以独立接受不附义务的赠与，也可以从事购买文具、彩票、赠与小礼物等与其年龄、智力相适应的民事法律行为。其所实施的超出自己年龄、智力状况的民事行为，之前是经父母同意的或者父母事后追认了，该民事行为也是有效的。法律依据:
