释义	依据我国土地管理法的规定，对耕地进行征收的，需要经有关部门的批准，并且制订征收补偿方案，如果不进行补偿的，是属于违规征地的情形。土地补偿费归农村集体经济组织所有;地上附着物及青苗补偿费归地上附着物及青苗的所有者所有;需要安置的人员由农村集体经济组织安置的，安置补助费支付给农村集体经济组织，由农村集体组织管理和使用;由其他单位安置的，安置补助费支付给安置单位;不需要统一安置的，安置补助费发放给被安置人员个人或者征得被安置人员同意后用于支付被安置人员的保险费用。
