虚假广告罪如何认定？
释义
法律分析：
广告主、广告经营者、广告发布者违反国家规定，利用广告对商品或服务作虚假宣传，情节严重的可能构成犯罪。所谓情节严重，主要是指多次实施虚假广告行为的；为多人实施虚假广告行为的；虚假广告，违法所得数额较大的；致使多人受骗上当的；造成恶劣影响的等。
法律依据：
《中华人民共和国刑法》 第二百二十二条 广告主、广告经营者、广告发布者违反国家规定，利用广告对商品或者服务作虚假宣传，情节严重的，处二年以下有期徒刑或者拘役，并处或者单处罚金。
