释义	法律分析: 对于犯罪中止的，没有造成损害的不予刑事处罚，就是不追究刑事责任；造成损害的，应减轻处罚，比如下毒故意杀人，但看到被害人痛苦挣扎，心生恻隐之心，遂将其送医院抢救，结果保住性命，仍然以故意杀人罪定罪，但是在法律规定的刑罚幅度内，减轻处罚，本来改判死刑，判无期，本来改判十五年判十年等等。法律依据: 《中华人民共和国刑法》第二十四条在犯罪过程中，自动放弃犯罪或者自动有效地防止犯罪结果发生的，是犯罪中止。对于中止犯，没有造成损害的，应当免除处罚；造成损害的，应当减轻处罚。
