释义	1、申请人依法提出书面的申请； 2、国务院专利行政部门收到发明专利申请后进行为期十八个月的初步审核，审核通过的，即行公布； 3、发明专利申请自申请日起三年内，通过实质审查的，发给发明专利证书。法律依据: 《中华人民共和国专利法》第二十六条申请发明或者实用新型专利的，应当提交请求书、说明书及其摘要和权利要求书等文件。第三十四条国务院专利行政部门收到发明专利申请后，经初步审查认为符合本法要求的，自申请日起满十八个月，即行公布。国务院专利行政部门可以根据申请人的请求早日公布其申请。
