释义	代位执行是指被执行人不能清偿债务，但对案外的第三人享有债权的，人民法院可以依申请执行人或被执行人的申请，对该第三人强制执行。在执行实践中，当被执行人不能履行债务时，执行被执行人到期债权，无疑是解决执行难的一个重要手段。法律依据《最高人民法院关于适用执行中华人民共和国民事诉讼最高人民法院法若干问题的意见》第一百零五条债务人的财产不能满足保全请求，但对第三人有到期债权的，人民法院可以依债权人的申请裁定该第三人不得对本案债务人清偿。该第三人要求偿付的，由人民法院提存财物或价款。
