释义	法律分析：有责底薪就是责任底薪，是当完成了单位每个月制定的业绩量才能拿到的底薪。与公司获利无直接联系。国家实行最低工资保障制度。最低工资的具体标准由省、自治区直辖市人民政府规定，报国务院备案。用人单位支付劳动者的工资不得低于当地最低工资标准。法律依据：《关于贯彻执行若干问题的意见》第五十六条之规定在劳动合同中，双方当事人约定的劳动者在未完成劳动定额或承包任务的情况下，用人单位可低于最低工资标准支付劳动者工资的条款不具有法律效力。
