释义	犯本罪的，处五年以上有期徒刑;其他参加的，处五年以下有期徒刑或者拘役。实践中，越狱的方式是多种多样的，如冲闯狱门、翻越狱墙、挖掘地道等。只要是多名在押罪犯有组织越狱行为，无论采取什么方式，都不影响本罪的构成。本罪只能由在监狱、劳改队等关押场所的罪犯构成。其他人员不能构成本罪。对于个别监管人员为越狱的罪犯提供帮助或方便条件的，而按组织越狱罪的共犯处理。法律依据《中华人民共和国刑法》第三百一十七条
