释义	在生活中，行为人在明知对方为精神病人的情况下，与精神病人发生性关系的，涉嫌强奸罪，毫无疑问涉嫌违法。与间歇性精神病患者在未发病期间发生性行为，妇女本人同意的，不构成强奸罪。法律依据：《残疾人保障法》第五十二条第五款奸淫因智力残疾或者精神残疾不能辨认自己行为的残疾人，以强奸论，依照刑法第一百三十九条的规定追究刑事责任。
