释义	法律分析：依据担保法司法解释的规定，解约定金就是为了解除合同而交纳的，所以合同解除后解约定金是有效的，如果是给付人解除合同的，定金不能要回，收受人解除合同的，双倍返还定金。《最高人民法院关于适用〈中华人民共和国担保法〉若干问题的解释》第一百一十七条规定，定金交付后，交付定金的一方可以按照合同的约定以丧失定金为代价而解除主合同，收受定金的一方可以双倍返还定金为代价而解除主合同。对解除主合同后责任的处理，适用《中华人民共和国合同法》的规定。
