释义	法律分析: 没有房产证的卖房合同一般情况下是有效的。一般情况下，只要是不存在合同无效的情形，依法成立的合同，对双方均具有约束力，是有效的；但房屋属于不动产，不动产所有权的变更以登记为准，合同虽然有效，但是房屋所有权并不会转移；只能要求卖方返还购房款承担违约责任，无法主张物权上的保护。《中华人民共和国民法典》第二百零九条不动产物权的设立、变更、转让和消灭，经依法登记，发生效力；未经登记，不发生效力，但是法律另有规定的除外。依法属于国家所有的自然资源，所有权可以不登记。
