释义	刑事自诉是指一些犯罪事实轻微的刑事案件，公安机关或者检察院认不予立案的时候，可以由被害人或其法定代理人、近亲属带刑事自诉状直接向人民法院提起诉讼。【法律依据】《中华人民共和国刑事诉讼法》第二百一十条自诉案件包括下列案件： (一)告诉才处理的案件; (二)被害人有证据证明的轻微刑事案件; (三)被害人有证据证明对被告人侵犯自己人身、财产权利的行为应当依法追究刑事责任，而公安机关或者人民检察院不予追究被告人刑事责任的案件。
