法律主观：

我国法律规定，所谓行政诉讼第三人，就是指因与被提起行政诉讼的具体行政行为有利害关系，通过申请或法院通知形式，参加到诉讼中来的其他公民、法人或者其他组织。

法律客观：

《行政诉讼法》第二十九条，公民、法人或者其他组织同被诉行政行为有利害关系但没有提起诉讼；或者同案件处理结果有利害关系的，可以作为第三人申请参加诉讼，或者由人民法院通知参加诉讼。人民法院判决第三人承担义务或者减损第三人权益的，第三人有权依法提起上诉。
