释义	法律分析：非婚生子女的生父母一方可以放弃抚养权，但放弃抚养权不能侵犯非婚生子女的权益，否则该行为无效。法律依据：《中华人民共和国民法典》第一百四十三条具备下列条件的民事法律行为有效：(一)行为人具有相应的民事行为能力；(二)意思表示真实；(三)不违反法律、行政法规的强制性规定，不违背公序良俗。第一千零七十一条非婚生子女享有与婚生子女同等的权利，任何组织或者个人不得加以危害和歧视。不直接抚养非婚生子女的生父或者生母，应当负担未成年子女或者不能独立生活的成年子女的抚养费。
