释义	法律分析: 格式条款在发生争议时，不能按照提供格式条款的一方的特别理解来解释，也不能按照相对方在订立该合同时的特定情形下的理解来解释，而应当按照通常的理解来解释。所谓通常的理解，是指通常情形下会订立该合同的一般人的理解。法律依据: 《中华人民共和国民法典》第四百九十八条对格式条款的理解发生争议的，应当按照通常理解予以解释。对格式条款有两种以上解释的，应当作出不利于提供格式条款一方的解释。格式条款和非格式条款不一致的，应当采用非格式条款。
