释义	法律分析: 聚众犯罪不是必须有主犯，主犯是相对于从犯而言的，主犯也并不等同于首要分子。聚众犯罪是按照首要分子和其他参与者来区分处罚的，不是按照主犯和从犯来处罚。法律依据:《《中华人民共和国刑法》》第二百八十九条【故意伤害罪】【故意杀人罪】【抢劫罪】聚众“打砸抢”，致人伤残、死亡的，依照本法第二百三十四条、第二百三十二条的规定定罪处罚。毁坏或者抢走公私财物的，除判令退赔外，对首要分子，依照本法第二百六十三条的规定定罪处罚。
