释义	现役军人打架的应由部队纪律部门或者军事法院管辖，地方法院没有管辖权。根据情节轻重进行处理，情节轻的可以批评教育、责令检讨或者禁闭、警告等处分，情节重的则予以记过、记大过、甚至免职、降级等处分。构成犯罪的，还将被开除军籍，并且应承担刑事责任。法律依据：《中华人民共和国治安管理处罚法》第四十三条殴打他人的，或者故意伤害他人身体的，处五日以上十日以下拘留，并处二百元以上五百元以下罚款；情节较轻的，处五日以下拘留或者五百元以下罚款。
