设计变更应以图纸或设计变更通知单的形式发出。改变有关工程的施工时间和顺序属于设计变更。变更有关工程价款的报告应由承包人提出。承包人在施工过程中更改施工组织设计的，应经业主和监理同意。

《中华人民共和国民法典》 第七百七十七条 定作人中途变更承揽工作的要求，造成承揽人损失的，应当赔偿损失。
