《国家大气污染物排放标准制订技术导则》（HJ 945.1-2018）明确规定，固定污染源是指排放大气污染物的各类行业企业、场所、生产设施、固定设备等，简称固定源。《固定源废气监测技术规范》（HJ/T397—2007）指明，污染源是排放大气污染物的设施或建筑构造（如车间等）。固定源是燃煤、燃油、燃气的锅炉和工业炉窑以及石油化工、冶金、建材等生产过程中产生的废气通过排气筒向空气中排放的污染源。国家根据排放污染物的企业事业单位和其他生产经营者污染物产生量、排放量、对环境的影响程度等因素，实行排污许可重点管理、简化管理和登记管理。

第二十八条 地方各级人民政府应当根据环境保护目标和治理任务，采取有效措施，改善环境质量。未达到国家环境质量标准的重点区域、流域的有关地方人民政府，应当制定限期达标规划，并采取措施按期达标。
第二十九条 国家在重点生态功能区、生态环境敏感区和脆弱区等区域划定生态保护红线，实行严格保护。各级人民政府对具有代表性的各种类型的自然生态系统区域，珍稀、濒危的野生动植物自然分布区域，重要的水源涵养区域，具有重大科学文化价值的地质构造、著名溶洞和化石分布区、冰川、火山、温泉等自然遗迹，以及人文遗迹、古树名木，应当采取措施予以保护，严禁破坏。
