释义	雇佣16-18岁的未成年工，是合法的，但是需要满足一定的特殊保护条件。雇佣童工是禁止的，即16周岁以下的员工，如果招用童工，一般的规定是每招一名罚款5000元，并责令将童工退回原籍。法律依据：《中华人民共和国劳动法》第五十八条国家对女职工和未成年工实行特殊劳动保护。未成年工是指年满十六周岁未满十八周岁的劳动者。第九十四条用人单位非法招用未满十六周岁的未成年人的，由劳动行政部门责令改正，处以罚款;情节严重的，由工商行政管理部门吊销营业执照。
