释义	法律分析: 破坏军婚罪是在一九九七年颁布的。破坏军婚罪具体是指明知是现役军人的配偶而与之同居或者结婚的行为，其中现役军人是指有军籍的，正在中国人民解放军、中国人民武装警察部队服役的官兵。构成破坏军婚罪的，一般处三年以下有期徒刑或者拘役。《刑法》第二百五十九条明知是现役军人的配偶而与之同居或者结婚的，处三年以下有期徒刑或者拘役。利用职权、从属关系，以胁迫手段奸淫现役军人的妻子的，依照本法第二百三十六条的规定定罪处罚。
