释义	法律分析: 是固定的。常见的不能办出产权证的车位也可以地简单分为两种。一种是已经列入公摊面积的车位。只要列入了公摊，从法律上来说就属于不能办出产权证的车位，因为是全体业主共有。因此该类车位不可以购买产权但可以租赁。法律依据: 《中华人民共和国民法典》第二百八十四条业主可以自行管理建筑物及其附属设施，也可以委托物业服务企业或者其他管理人管理。对建设单位聘请的物业服务企业或者其他管理人，业主有权依法更换。
