释义	1、客体是侵犯了金融管理秩序和公私财产所有权，为复杂客体，并且前者为主要客体。2、客观方面表现为：采用虚构事或者隐瞒事实真相的方法，破坏金融管理秩序而骗取公私财物，并且是数额较大的行为。3、主体为一般主体，单位和自然人均可以构成。但下列三种犯罪不能由单位构成：贷款诈骗罪、信用卡诈骗罪和有价证券诈骗罪。4、主观上都是故意，并且具有非法占有公私财产的目的。这也是本类罪区别于破坏金融管理秩序类犯罪的重要依据。法律依据《中华人民共和国刑法》第三章，第五节
