释义	法律分析：在校的学生是不能与用人单位建立劳动关系的，也就是说，是不能签订劳动合同的。在校生去用人单位实习是以学生的身份实习的，目的只是勤工俭学，不以就业为目的，自然不能视为就业，在校生与用人单位未建立劳动关系，也就可以不用签订劳动合同。但是在校生可以与单位签订劳务协议，或者签订实习协议，并在协议中规定双方的权利义务。法律依据：《关于贯彻执行〈中华人民共和国劳动法〉若干问题的意见》第十二条在校生利用业余时间勤工俭学，不视为就业，未建立劳动关系，可以不签订劳动合同。
