释义	律师分析：不一定，如果淫秽物品没有流入社会、妨害社会管理秩序，仅仅是当事人自己拥有，其对犯罪客体的侵害没有发生，不具备社会危害性，也就不符合犯罪构成的条件，当然不能成为惩治的对象。【法律依据】：《中华人民共和国治安管理处罚法》第六十八条规定制作、运输、复制、出售、出租淫秽的书刊、图片、影片、音像制品等淫秽物品或者利用计算机信息网络、电话以及其他通讯工具传播淫秽信息的，处十日以上十五日以下拘留，可以并处三千元以下罚款；情节较轻的，处五日以下拘留或者五百元以下罚款。
