释义	满足条件的企业应当成立公会,这是强制性要求,对于不满足条件的企业不作强制要求。但是虽未强制企业建立工会，但工会越来越受到政府的重视，法律法规在进行有关制度设计时往往以企业成立工会为前提。因成立工会不是对企业的强制性要求，因此我国法律暂时没有规定企业不成立工会的惩罚方法。但如前所述，工会是一系列制度实施的前提，若无工会，工资集体协商制度、集体合同的签署及职工代表大会的存续、运行等在法律上将存在一定瑕疵。
