释义	重婚罪的认定标准是：有配偶而重婚的，或者明知他人有配偶而与之结婚的属于重婚罪。有配偶的人与他人结婚或者以夫妻名义长期生活，一定会构成重婚。但如果第三者不知情的情况下与有配偶的人结婚就不是构成犯罪。法律依据: 《刑法》第二百五十八条有配偶而重婚的，或者明知他人有配偶而与之结婚的，处二年以下有期徒刑或者拘役。《民法典》第一千零四十二条禁止包办、买卖婚姻和其他干涉婚姻自由的行为。禁止借婚姻索取财物。禁止重婚。禁止有配偶者与他人同居。禁止家庭暴力。禁止家庭成员间的虐待和遗弃。
