释义	法律分析：用人单位调岗降薪不合法。调岗调薪属于擅自变更劳动合同。而变更劳动合同必须要与劳动者协商一致，如果没有协商一致就变更劳动合同的，变更的劳动合同无效。即使是因为劳动者工作能力不行，需要调岗降薪的，也需要与劳动者协商，而不得单方面调岗降薪。法律依据：《中华人民共和国劳动合同法》第三十五条用人单位与劳动者协商一致，可以变更劳动合同约定的内容。变更劳动合同，应当采用书面形式。变更后的劳动合同文本由用人单位和劳动者各执一份。
