释义	法律分析：在现实生活中旅客报团旅游的时候，一般要向旅行社交纳一定数额的定金，并且与旅行社签订合同，签订合同有利于保障当事人的利益，并且避免纠纷的出现。依据我国旅游法的规定，旅客交纳定金后未签订旅游合同的，如果非因旅客原因造成不能签订合同的，如成团人数不足无法出行的，定金是要退还的。法律依据：《中华人民共和国旅游法》第六十三条旅行社招徕旅游者组团旅游，因未达到约定人数不能出团的，组团社可以解除合同。但是，境内旅游应当至少提前七日通知旅游者，出境旅游应当至少提前三十日通知旅游者。
