法律分析：一方死亡的，若财产为夫妻共同财产，其财产中一半作为继承财产进行分配，若财产为一方个人财产，该财产作为继承财产进行分配。根据法律规定现任配偶、子女、父母为第一顺序继承人，如果其存在公证遗嘱，按照公证遗嘱继承，如果没有，将照法定继承进行继承。再婚夫妻一方死亡房产原则上由配偶、子女、父母继承。但是如果被继承人生前立有遗嘱的话，则按照遗嘱的意思，确定房产的归属，否则就按照法定继承办理。如果是夫妻共有财产的情况，夫妻一方死亡的，夫妻共有的房产先进行分割，属于去世一方的房产进行继承，继承开始后有遗嘱的按遗嘱进行继承，没有遗嘱的按法定继承顺序进行继承，如果房产属于去世一方单独所有不需要分割直接按照遗嘱进行继承，没有遗嘱按照法定继承顺序继承。如果房产属于未去世一方单独所有不需要进行继承。
法律依据：《中华人民共和国民法典》 第一千零六十二条 夫妻在婚姻关系存续期间所得的下列财产，为夫妻的共同财产，归夫妻共同所有：
(一)工资、奖金、劳务报酬(二)生产、经营、投资的收益(三)知识产权的收益(四)继承或者受赠的财产，但是本法第一千零六十三条第三项规定的除外(五)其他应当归共同所有的财产。
夫妻对共同财产，有平等的处理权。
