释义	法律分析：债务人失踪的则不能履行还款责任，此时代表人需要承担担保责任，也就是需要对债务承担偿还责任。担保人在承担了担保责任后可以向债务人追偿。担保人可以向法院提起诉讼要求债务人还款，法院受理后公告传唤债务人应诉，公告期限届满，债务人仍不应诉，借贷关系明确的，经审理后可缺席判决。法律依据：《民事诉讼法》第一百四十四条，被告经传票传唤，无正当理由拒不到庭的，或者未经法庭许可中途退庭的，可以缺席判决。
