释义	法律分析：申请人申请公司破产后，在法院受理破产申请前，申请人是可以撤回申请的。在人民法院宣告企业破产之前，破产申请人可以请求撤回破产申请。对申请人撤回申请的，人民法院应作出准予或者不准予的裁定，当事人对该裁定不得上诉。人民法院准予申请人撤回破产申请的，在人民法院裁定准予之前，因破产申请所引起的损失，由破产申请人承担。撤回申请是申请人的处分权利，但是这一行为必须在法律规定的范围内实施。法律依据：《中华人民共和国企业破产法》第九条人民法院受理破产申请前，申请人可以请求撤回申请。
