释义	法律分析：违法行为构成犯罪的，行政机关必须将案件移送司法机关，依法追究刑事责任。法律依据：《中华人民共和国行政处罚法》第三十二条行政机关在作出行政处罚决定之前，应当告知当事人作出行政处罚决定的事实、理由及依据，并告知当事人依法享有的权利。行政机关未依照上述规定履行告知义务的，构成行政处罚程序违法。
