释义	法律分析：对没有在法定上诉期回内递交上诉状的当事人，人民法院只能认为其未提起上诉。如果双方当事人已经错过了上诉期限，人民法院的一审裁判就会发生法律效力。这时候就只能通过向人民法院提起申诉的方式，启动审判监督程序，通过再审来改变人民法院的判决。法律依据：《中华人民共和国刑事诉讼法》第二百三十条不服判决的上诉和抗诉的期限为十日，不服裁定的上诉和抗诉的期限为五日，从接到判决书、裁定书的第二日起算。
