释义	根据最高人民法院(1986年3月21日)《关于继母与生父离婚后仍有权要求已与其形成抚养关系的继子女履行赡养义务的批复》精神：继母与继子女间既存在姻亲关系，又存在由于长期共同生活而形成的抚养关系。尽管继母与生父离婚，婚姻关系消除了，但继母与继子女已经形成的抚养关系不能消失。因此，有负担能力的继子女对曾经长期抚养教育过他们的年老体弱、生活困难的继父母应尽赡养扶助之义务。只有继父母或继子女双方协议解除继父母子女关系时才可以准许，但对于生活困难，无劳动能力的继父母晚年的生活费用应该由继子女承担。
