释义	由于不可抗力和意外事件造成他人损害的，不是犯罪，现行《刑法》已经对此作了明文规定，行为在客观上虽然造成了损害结果，但是不是处于故意或者过失，而是由于不能抗拒或者不能预见的原因引起的，不是犯罪。也就是说，由于不可抗力和意外事件造成他人损害的，不是犯罪，行为人无需承担刑事责任。法律依据《中华人民共和国刑法》第十六条
