释义	法律分析：居住权的性质、本质决定了其应当是一种无须支付对价的无偿行为，即使居住权人在其居住期间可能需要支付给所有人一定的费用，但它必然要低于租金，否则也就无设立之必要。法律依据：《中华人民共和国民法典》第三百六十八条居住权无偿设立，但是当事人另有约定的除外。也就是说，一般情况下是无偿设立，但并不排斥当事人之间的自愿约定，如果另有约定的则依照约定。同时，设立居住权的，应当向登记机构申请居住权登记，居住权自登记时设立。
