释义	法律分析：抢先注册商标可以被视为是一种侵权的行为。商标抢注已经违反了我国的诚实信用的原则，诚实信用原则是民法的基本原则，也是商标法对申请商标注册和使用商标作出明确规定的原则。商标注册人明知道是他人的商业标志，却用自己的名义抢先注册商标，并且还要企图将他人的商业标识冒充是自己的商标，践踏了起码的商业道德，违反了诚信的原则。法律依据：《中华人民共和国商标法》第三十二条申请商标注册不得损害他人现有的在先权利，也不得以不正当手段抢先注册他人已经使用并有一定影响的商标。
