释义	法律分析：民事诉讼过程中，被告死亡的，法院应当中止审理，等待被告的继承人是否参加诉讼。如果经通知参加诉讼，依法变更被告。如果经通知，其继承人不参加，应当依法作出判决，并可以强制执行被告的遗产。法律依据：《最高人民法院关于适用〈中华人民共和国民事诉讼法〉的解释》第四百七十五条作为被执行人的公民死亡，其遗产继承人没有放弃继承的，人民法院可以裁定变更被执行人，由该继承人在遗产的范围内偿还债务。继承人放弃继承的，人民法院可以直接执行被执行人的遗产。
