释义	法律分析：生产经营超过有效期的化妆品，应当处以停产或停止经营化妆品三十天以内的处罚，对经营者并可以处没收违法所得及违法所得二到三倍罚款的处罚。法律依据：《化妆品卫生监督条例》第十三条化妆品经营单位和个人不得销售下列化妆品：（一）未取得《化妆品生产企业卫生许可证》的企业所生产的化妆品；（二）无质量合格标记的化妆品；（三）标签、小包装或者说明书不符合本条例第十二条规定的化妆品；（四）未取得批准文号的特殊用途化妆品；（五）超过使用期限的化妆品。
