释义	1、赠与合同无效后，受赠方应当将所得到的财产返还给赠与的一方，赠与的一方要接受这个财产。2、如果因为赠与行为无效，给双方或者一方造成了损失的，要看造成赠与合同无效的过错方是谁，有过错的一方要向没有过错的一方进行赔偿，如果没有损失就不存在赔偿。如果双方都有过错，双方都有损失，应当各自承担相应的责任。法律依据《中华人民共和国民法典》第一百五十七条
