释义	法律分析：本人知道他人以本人名义实施民事行为而不作否认表示的，视为同意，是表见代理制度的原则性规定；被代理人知道代理人以其名义进行活动，而容忍了该行为；或者被代理人尽管不知道代理人有此活动，但如果被代理人尽到相当注意，就可以知道，这时的被代理人要承担表见代理的责任。主要规定在《民法典》中。法律依据：《中华人民共和国民法典》第一百七十二条行为人没有代理权、超越代理权或者代理权终止后，仍然实施代理行为，相对人有理由相信行为人有代理权的，代理行为有效。
