法律主观：
对 毒品犯罪 的 刑事责任年龄 的规定，对已满14周岁不满16周岁的人，犯贩卖毒品罪的，应当负刑事责任。对于被利用、教唆、胁迫参加贩卖毒品犯罪活动的已满十四周岁不满十六周岁的人，一般可以不追究其刑事责任。
法律客观：
《 刑法 》第十七条规定，已满十四周岁不满十六周岁的人，犯故意杀人、 故意伤害致人重伤 或者死亡、强奸、 抢劫 、贩卖毒品、放火、爆炸、投毒罪的，应当负刑事责任。
