释义	违建房的出租合同是无效的。在违法建筑物范围认定上，确定未取得建设工程规划许可证或者未按照建设工程规划许可证规定建设的“房屋”，未经批准或者未按照批准内容建设的临时建筑，超过批准使用期限的临时建筑为违法建筑。法条根据：《中华人民共和国商品房屋租赁管理办法》第六条有下列情形之一的房屋不得出租：(一)属于违法建筑的;(二)不符合安全、防灾等工程建设强制性标准的;(三)违反规定改变房屋使用性质的;(四)法律、法规规定禁止出租的其他情形。该内容由陈亚楠律师和点行律询共创回答
